This web page provides information on the Department for Energy and Mining (DEM) process to develop updated mining regulations. The mining regulations are required to support the Statutes Amendment (Mineral Resources) Act 2019 (hereafter Mining Act), which was passed on 17 October 2019.

Engagement activities update

The regulations engagement timeline and process have been revised in response to nationwide guidelines to contain the spread of the COVID-19 virus.

  • There will be a change to the release dates and the order in which the draft regulation topics will be released for public consultation, in two larger bundles during Q3, 2020.
  • Regional face-to-face meetings planned for April will be replaced by digital engagement, short video messages, and call-ins. These online channels will enable the department to obtain input on the regulations while social distancing protocols remain in force.
  • The timeline for lodging public submissions will be extended to ensure people have more time to provide input on the draft regulations as they are made public.

The Department is working to minimise the disruption to the engagement process caused by the pandemic response and ensure that the views of the public can be heard while maintaining health protocols.

The purpose of the regulations

The regulations outline how the provisions of the Mining Act are applied.

By law, the regulations cannot bring up new issues and topics outside the scope of the Act, and need to be written in a way that explains how the Act will operate and how DEM will regulate mining in our state.

Regulations engagement process

Draft regulations will be released for the public and groups to provide comments, at different stages throughout the year. Background documents will be provided to support the writing of submissions. Such a staged approach means people will not have to read one large document within a short time frame at the end of 2020.

You can comment on all, or just one or more, specific topics of the draft regulations, as outlined in the engagement process below, throughout the year. It’s up to you.

The draft regulations will be emailed to interested parties who register above, and posted on this web page and the South Australian Government's YourSAy website.

Comments with your input on the draft regulations need to be made via the submission form which will be provided on this website and the South Australian Government's YourSAy website.

How will your feedback influence the final regulations?

Feedback  

Feedback will be collated and considered by DEM and regularly reported back to interested people and groups on the key themes and input received.

Although feedback on the regulations will not automatically be included in the final regulations, your feedback provides an opportunity to recommend and inform changes to improve the draft regulations. Where the input aligns with the Mining Act and the DEM Strategic Direction 2018 to 2021, and is considered to improve the draft regulations towards more effective and efficient implementation of the Mining Act, DEM will consider the suggested input.
